TERMS OF SERVICE

- Version
- 1.0.0
These Terms are a binding agreement between you and Duel LLC, a Georgia limited liability company (“Duel”, “we”, “us”), when you create an account, play practice games, or enter skill-based competitions. They include an agreement to resolve disputes by individual arbitration and a waiver of class actions (Section 19). Read them together with the Skill Gaming & Contest Rules, the Payment, Deposit & Withdrawal Policy, the Jurisdiction & Eligibility Policy and the Privacy Policy.
1. Eligibility
- Duel is intended only for individuals who are 18 years of age or older.
- One account per individual. Additional or duplicate accounts may be restricted or closed.
- You must provide accurate account information, including your date of birth, and keep it current.
- Accounts are personal. They may not be transferred, sold, gifted, rented or shared.
- You must satisfy the identity and location requirements that apply to the activity you are attempting.
- Duel may request additional information or verification at any time, including before allowing a withdrawal.
Age is enforced at the account level: your date of birth is validated when your account is completed, and it is not visible to other players.
2. Jurisdiction and location
Real-money competitions may only be accessed while you are physically located in a jurisdiction where Duel makes them available. The current availability list is maintained in our jurisdiction configuration and published on the Jurisdiction & Eligibility Policy page rather than restated here, so that a single configuration governs both the product and this document.
- The residence recorded on your account does not by itself determine eligibility.
- Your current location may be verified before a real-money action is permitted.
- Individual games or competition formats may carry different jurisdiction restrictions.
- Duel may add, suspend or remove availability in any jurisdiction, including where required to do so.
- Attempting to circumvent location controls is prohibited and may result in restriction or closure of your account.
Free practice play and withdrawal of an existing available balance may remain available where real-money entry is not.
3. Skill-based competitions
Duel offers head-to-head and other approved competition formats in which the result is determined by each player's performance in the applicable game, scored under that game's published rules. Public matches and private, invitation-based matches use the same competition engine, the same account ledger and the same rules.
Every game offered for real-money entry must have published rules stating its:
- objective
- scoring method
- winning conditions, including any early-decision condition
- tie handling
- time limits and per-decision timers
- disconnect and interruption handling
- forfeit conditions
- prohibited conduct
Outcomes are determined by skill. There is no random prize draw, and no outcome is decided by chance. Both players in a round play the same seeded course, so neither player receives an easier layout. Duel never plays against you for money and never competes in a match; Duel is not a party to any wager.
4. Entry fees and prizes
Before you confirm entry into a real-money competition, the interface shows you the entry amount and the potential prize for that competition. By confirming entry you authorise Duel to place the entry amount on hold against your available balance for the duration of the competition.
- Duel may retain a platform service fee out of a competition's total entry amounts. Where a fee applies, the prize shown before entry already reflects it.
- Settlement is final once the competition is resolved under the applicable game rules and recorded in your account ledger.
- A competition may be voided or cancelled where it cannot be completed fairly, for example a server failure, a suspected integrity violation, or a competition that never receives a second player. Held amounts for a voided or cancelled competition are released back to your available balance.
- Deposit refunds, chargebacks and payment disputes are handled under the Payment, Deposit & Withdrawal Policy, and may lead to a review of your account and of affected competitions.
5. Your Duel account balance
Your Duel balance is an internal ledger entry that records amounts available to you for competition entry or withdrawal on the platform. It is not a bank account. It is not insured, it does not earn interest, and it is not a general-purpose payment instrument.
The ledger distinguishes your available balance from amounts currently held for an in-progress competition or a pending withdrawal request. Held amounts cannot be spent twice.
Duel is not a bank, financial institution, money transmitter or escrow agent, and nothing in these Terms creates a fiduciary relationship. Your balance is a contractual record of what Duel owes you under these Terms, subject to the rules on verification, holds, chargebacks and violations set out here.
6. Withdrawals
- You may request a withdrawal of your available balance. Amounts held for an active competition or an existing withdrawal request are not available.
- Identity verification must be complete before a withdrawal is processed.
- The payout destination must belong to you and must match the verified name on your account.
- Each request is reviewed before payout. Reviews may include fraud, security, integrity and compliance checks.
- A withdrawal may be declined, returned or reversed by the payout provider. Where that happens the amount is returned to your Duel balance and you will be able to request it again.
- Payout methods available at any time are shown in the withdrawal flow and may change.
- Duel may place or maintain a hold on a withdrawal while an investigation into fraud, chargebacks, payment disputes or competition integrity is open, where doing so is legally permitted.
Withdrawals are reviewed and paid out manually. Duel does not promise a specific processing time, and any time estimate shown in the product is an estimate only.
7. Identity verification
Duel uses Didit as its identity and compliance verification provider. You authorise Duel and its approved service providers to collect and process the information reasonably necessary to verify, depending on the workflow enabled for your verification:
- your identity and legal name
- your date of birth and that you meet the minimum age
- a government-issued identification document
- a facial or liveness comparison against that document
- sanctions or anti-money-laundering screening where applicable
- that the payout destination you provide belongs to you
- fraud and account-integrity risk signals
Duel stores the outcome of verification and a limited set of verified fields. Identification images and biometric comparison data remain with the verification provider. The Privacy Policy sets out exactly which fields Duel retains.
8. Location verification
To determine eligibility for real-money competitions, Duel requests your device location (GPS) once each time you open the app, with your permission, and also processes network signals such as your IP address, the region derived from it and indicators of a proxy or VPN. Paid actions rely on that stored decision. If you decline location permission, real-money competitions are unavailable, but free play remains available. Your IP address is stored in hashed form.
You may not:
- spoof or simulate device location
- use a VPN, proxy, relay, remote desktop or similar system to appear to be somewhere you are not
- manipulate your device, browser or network to alter location signals
- provide a false residence or location on your account
- otherwise bypass or interfere with jurisdiction controls
If location cannot be confirmed, real-money actions are paused rather than allowed.
9. Fair play and anti-cheating
The following are prohibited in any Duel competition:
- bots, macros, scripts or any form of automated play
- modified, repackaged or unofficial clients
- exploiting bugs, defects or unintended behaviour
- manipulating, forging or replaying scores or game state
- collusion between players or coordinated match outcomes
- intentionally losing in order to transfer value to another account
- account sharing, playing on another person's account, or operating multiple accounts
- unauthorised software that reads, injects into or alters the game
- manipulating network conditions, latency or connection state to affect a result
- interfering with another player's ability to compete
- circumventing, disabling or probing anti-cheat and integrity systems
Where Duel identifies or reasonably suspects a violation, it may:
- investigate, including by reviewing recorded gameplay data and account activity
- void or re-run an affected competition and release the associated holds
- suspend real-money functionality on the account while the review is open
- restrict features, close the account, or decline future entry
- decline to pay out a disputed amount while an investigation is open, where legally permitted
If Duel determines, after review, that a violation occurred, Duel may cancel prizes and winnings obtained through or affected by the violation, reverse the related settlements, and return entry amounts to the players who were harmed. Deposits you made with your own lawfully obtained funds that were not used in or gained through a violation are not forfeited; they are returned to you, less any amounts owed to Duel (for example from a chargeback), when your account is closed. You will be told the outcome and may request a review by emailing support.
10. Match disputes and interruptions
Each game's published rules govern how its results are determined. In addition:
- Disconnects and crashes: a competition continues under its published rules; a player who cannot submit a result within the applicable deadline may forfeit that round.
- Server or platform failure: an affected competition may be voided and the holds released rather than settled on incomplete data.
- Ties: a tied round does not settle the competition. A new round with a fresh seed is issued until the competition is decided.
- Abandoned competitions: a competition that is never joined, or is abandoned before play, is cancelled and the entry hold released.
- Delayed starts: both players are given a synchronised start; a player who does not start within the deadline may forfeit.
- Incorrect scores or suspected cheating: report it from the match screen or by email within 7 days of the competition. Duel reviews the recorded round data and responds through your account or by email.
- Duel's server-side record of a competition is the authoritative record of what occurred.
11. Intellectual property
Duel and its licensors own the platform software, the games, game logic and artwork, the Duel name, wordmark and logos, the user interface, and the text, graphics and other materials made available through the service. You receive a limited, personal, revocable, non-transferable licence to use the platform for personal, non-commercial play in accordance with these Terms. No other rights are granted.
12. Acceptable use
You agree not to:
- attempt to gain unauthorised access to any account, system or data
- reverse engineer, decompile or disassemble the platform, to the extent that restriction is enforceable in your jurisdiction
- scrape, crawl or bulk-collect data from the platform
- harass, threaten, defame or abuse other players or Duel staff
- impersonate another person or misrepresent your identity
- engage in fraud, money laundering, or use of funds that are not lawfully yours
- abuse the support process, including by submitting knowingly false reports or disputes
- use the platform for commercial purposes without written permission
- interfere with or place unreasonable load on Duel infrastructure
13. Suspension and termination
Duel may restrict, suspend or close an account where it reasonably believes:
- these Terms or another Duel policy has been violated
- the account holder does not meet eligibility, age, identity or location requirements
- there is fraud, chargeback abuse, unauthorised payment activity or a security risk
- verification requested from the account holder has not been completed
- the account is subject to self-exclusion, or continued play would be inconsistent with a responsible-gaming request
- restriction is required by law or by a service provider
You may close your account at any time by contacting support. Where an account is restricted or closed, you may ask for the reason and request a review by emailing support@getduel.app. Duel aims to acknowledge review requests and to explain the outcome to the extent it is legally able to.
14. Duel Coins, Snipes and virtual items
- Duel Coins, Snipes, characters, cosmetics and other virtual items are a limited, revocable licence to use a feature of the service. You do not own them.
- Virtual items have no cash value. They cannot be withdrawn, redeemed for money, transferred, sold or traded, and they cannot be used as a competition entry or prize.
- Purchases made in the App Store or Google Play are processed by Apple or Google under their terms. Refund requests for those purchases go to Apple or Google.
- Except where the law requires otherwise, virtual-item purchases are final and are not refunded if your account is closed, suspended or the item is changed or retired.
- A Snipe reveals the creator of an eligible open match only after you confirm the spend. It does not reserve, join or guarantee a match.
- Duel may change, rebalance or retire virtual items and their prices.
15. App store terms
If you downloaded Duel from the Apple App Store or Google Play, these Terms are between you and Duel LLC only, not Apple or Google. Apple and Google have no obligation to provide maintenance or support, are not responsible for the app or its content, and are not responsible for any claim relating to the app, including product-liability, legal-compliance or intellectual-property claims. To the maximum extent permitted by law, their only obligation if the app fails to conform to a warranty is to refund its purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
Real-money competitions are not offered, sponsored or endorsed by Apple or Google.
16. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. Duel does not warrant that the service will be uninterrupted, error-free, secure or free of harmful components, or that any connection, device or network will perform well enough for competitive play.
You are responsible for your device, connection and data plan. Connection problems on your side are handled under the published match rules and are not a basis for reversing a result.
17. Limitation of liability
To the maximum extent permitted by law, Duel LLC and its members, managers, employees, contractors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost winnings, lost data or loss of goodwill, arising out of or relating to the service or these Terms, even if advised of their possibility. Duel's total liability for all claims relating to the service or these Terms will not exceed the greater of (a) the amounts you paid to Duel in the six months before the event giving rise to the claim, excluding amounts already returned to you or withdrawn, or (b) one hundred U.S. dollars ($100).
This section does not limit your right to withdraw your available balance under these Terms, or any liability that cannot be limited by law. Some jurisdictions do not allow certain limitations, so some of them may not apply to you.
18. Indemnification
You agree to defend, indemnify and hold harmless Duel LLC and its members, managers, employees and contractors from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of any law or the rights of another person, your use of the service from a location where it is not permitted, or any fraudulent payment or chargeback you initiate.
19. Dispute resolution, arbitration and class-action waiver
Please read this section carefully. It affects your legal rights, including your right to go to court and to bring a class action.
Informal resolution first. Before starting arbitration or a small-claims case, you and Duel each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for at least 30 days. Send notices to support@getduel.app with the subject "Legal Notice", including your username and account email.
Binding individual arbitration. Any dispute, claim or controversy arising out of or relating to these Terms or the service that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration may be held by video, by phone or on written submissions, or in person in the county where you live or in Fulton County, Georgia. For claims within AAA's consumer fee schedule, fees are allocated as those rules provide. The Federal Arbitration Act governs this section. The arbitrator decides all questions about the scope and enforceability of this agreement to arbitrate, except as stated below.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek court relief to stop infringement or misuse of intellectual property.
Class-action and jury waiver. You and Duel may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. You and Duel each waive the right to a jury trial. If this class-action waiver is found unenforceable for a particular claim, that claim must be severed and heard in court, and the rest of this section still applies.
Mass filings. If 25 or more similar demands are filed by or with the help of the same counsel, they will be administered in batches under AAA's mass-arbitration procedures, and the limitations period for unfiled claims is paused while the batches proceed.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@getduel.app within 30 days of first accepting these Terms, with the subject "Arbitration Opt-Out" and your username and account email. Opting out does not affect any other part of these Terms.
Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
Governing law and venue. These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any claim not subject to arbitration will be heard exclusively in the state or federal courts located in Fulton County, Georgia, and you and Duel consent to their jurisdiction.
20. General terms
- Entire agreement: these Terms and the policies they reference are the entire agreement between you and Duel about the service.
- Severability: if any provision is found unenforceable, it is limited to the minimum extent necessary and the rest remains in effect.
- No waiver: Duel's failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms. Duel may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure: Duel is not responsible for delays or failures caused by events outside its reasonable control, including outages of hosting, payment, app-store or network providers.
- Electronic communications: you agree to receive notices electronically, in the app or by email.
- Survival: sections that by their nature should survive termination — including balances owed, virtual items, disclaimers, limitation of liability, indemnification and dispute resolution — survive.
21. Changes to these Terms
Duel may update these Terms. The version number, effective date and last-updated date at the top of this page identify the current text. Material changes will be announced in the app before they take effect; continuing to use the service after that date means you accept them. Changes to Section 19 do not apply to a dispute you had already notified to Duel.
